In Section Four of the Chatham County Subdivision Regulations, the following six categories of division of land are specified as being exempt from the Subdivision Regulations:
- The combination or recombination of portions of previously platted lots if the total number of lots is not increased and the resultant lots are equal to or exceed the standards of the county as shown in its subdivision regulations.
- The division of land into parcels greater than ten (10) acres if no street right-of-way dedication is involved.
- The public acquisition by purchase of strips of land for widening or opening streets or other public transportation corridors or greenways.
- The division of a tract in single ownership, the entire area of which is not greater than two acres, into not more than three lots if no street right-of-way dedication is involved and if the resultant lots are equal to or exceed the standards of the county as shown by its subdivision regulations.
- A conveyance made for the purpose of dividing up the estate of a decedent among his/her heirs and devises, by will or the courts.
- The combination or recombination of previously recorded lots or portions of previously recorded lots if the total number of lots is not increased, provided the resultant lots meet or exceed the standards of the Health Department.
While these divisions are exempt from the Subdivision Regulations, the Subdivision Administrator generally reviews and signs the plat certifying that it is exempt from the Chatham County Subdivision Regulations (Section 11, Form 7 in the Subdivision Regulations):
CERTIFICATION OF PLAT BEING EXEMPT FROM THE SUBDIVISION REGULATIONS
I hereby certify that the property shown and described hereon is exempt from the subdivision regulations of Chatham County by definition.
